Welcome to AI Push Up Counter. By downloading, installing, or using our application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

AI Push Up Counter is a fitness application that uses AI-powered pose detection to count push-ups, track workouts, and monitor your fitness progress. The App offers both free and premium subscription features.

3. User Accounts

  • You may create a profile within the App to personalize your experience
  • You are responsible for maintaining the accuracy of your profile information
  • Your workout data is stored locally on your device

4. Subscriptions and Payments

4.1 Pro Subscription

The App offers a Pro subscription that unlocks additional features including:

  • Advanced workout modes (EMOM, Tabata, Max Reps)
  • Unlimited workout history
  • Advanced analytics and insights
  • Detailed progress tracking

4.2 Billing

  • Subscriptions are billed through the Apple App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Cancellation

You can manage and cancel your subscription through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.

4.4 Free Trial

If offered, free trial periods convert to paid subscriptions unless canceled before the trial ends. Any unused portion of a free trial is forfeited when purchasing a subscription.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with the proper functioning of the App
  • Use the App in any way that could damage or impair the service

6. Health Disclaimer

Important: The App is designed for general fitness tracking purposes only. It is not intended to provide medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before starting any exercise program.
  • The App's form feedback and scoring are approximations and should not replace professional fitness instruction
  • Calorie estimates are approximate calculations and may vary based on individual factors
  • You exercise at your own risk and are responsible for your physical health and safety
  • Stop exercising immediately if you experience pain, discomfort, or other symptoms

7. Intellectual Property

The App, including all content, features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice within the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
