Welcome to aiSummerizer. These Terms of Service ("Terms") govern your use of the aiSummerizer mobile application ("App", "Service", "we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using aiSummerizer, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

aiSummerizer is an AI-powered meeting transcription and summarization application that allows users to:

  • Record audio from meetings and conversations
  • Transcribe audio using artificial intelligence
  • Generate AI-powered summaries of transcribed content
  • Import and export audio files
  • Chat with AI about meeting content
  • Organize and manage meeting recordings

3. Subscription Plans and Pricing

3.1 Free Tier

The free version of aiSummerizer includes:

  • Up to 3 meeting recordings
  • Basic transcription features
  • AI summary generation
  • Text export functionality

3.2 Pro Subscription

Our Pro subscription unlocks premium features including:

  • Unlimited meeting recordings
  • Recordings up to 100 minutes in length
  • AI summaries and translations
  • Import and export recordings
  • PDF export functionality
  • YouTube transcription capability

3.3 Pricing and Payment

Subscription pricing is determined by the Apple App Store or Google Play Store and may vary by region, currency, and platform. Prices are displayed in your local currency at the time of purchase. Payment will be charged to your App Store or Google Play account upon confirmation of purchase.

3.4 Free Trial

New subscribers may be eligible for a free trial period. The trial duration will be clearly displayed before purchase. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged the subscription fee.

3.5 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.6 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

4. User Accounts and Responsibilities

4.1 No User Accounts

aiSummerizer does not require user account creation. All data is stored locally on your device.

4.2 Your Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Comply with all applicable laws and regulations
  • Obtain necessary consent before recording any conversations
  • Not use the App to record private conversations without consent
  • Not violate any third-party rights including privacy, publicity, copyright, or other intellectual property rights
  • Maintain the confidentiality of any sensitive information processed through the App

5. Recording Consent and Legal Compliance

Important: You are solely responsible for ensuring you have the legal right and necessary consent to record any conversations. Recording laws vary by jurisdiction, and some regions require all parties to consent to being recorded. Failure to obtain proper consent may result in civil or criminal liability.

We expressly disclaim any liability arising from your failure to comply with applicable recording consent laws.

6. Artificial Intelligence and Third-Party Services

6.1 AI-Generated Content

Our App uses artificial intelligence services provided by OpenAI to transcribe audio and generate summaries. You acknowledge and agree that:

  • AI-generated transcriptions and summaries may contain errors or inaccuracies
  • Your audio recordings and transcripts will be processed by OpenAI's servers
  • OpenAI's terms of service and privacy policy apply to the processing of your content
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • You should review and verify all AI-generated content before relying on it

6.2 Third-Party Services

The App integrates with the following third-party services:

  • OpenAI: For transcription and AI features
  • Firebase Analytics: For app analytics and crash reporting
  • RevenueCat: For subscription management

Your use of these services is subject to their respective terms of service and privacy policies.

7. Content Ownership and License

7.1 Your Content

You retain all ownership rights to the content you create, record, or upload through the App, including audio recordings, transcripts, and summaries. By using the App, you grant us a limited license to process your content solely for the purpose of providing the Service.

7.2 Our License to Your Content

By using AI features, you grant OpenAI the right to process your audio and text content according to their terms of service. This processing is necessary to provide transcription and AI summary features.

7.3 App Content

All intellectual property rights in the App, including software, design, text, graphics, and other materials, are owned by us or our licensors. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Data Storage and Backup

All meeting recordings, transcripts, and summaries are stored locally on your device. We do not provide cloud backup services. You are responsible for:

  • Backing up your data if desired
  • Understanding that uninstalling the App may result in permanent data loss
  • Exporting important data before device changes or resets

9. Prohibited Uses

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Record conversations without required consent
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the App to transmit harmful, offensive, or illegal content
  • Interfere with or disrupt the App's functionality
  • Use automated systems to access the App without authorization
  • Violate any third-party rights

10. Disclaimers and Limitations of Liability

10.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Accuracy of AI Content

We do not warrant that AI-generated transcriptions or summaries will be accurate, complete, or error-free. You acknowledge that AI technology has limitations and may produce incorrect or misleading results.

10.3 Service Availability

We do not guarantee that the App will be available at all times or that it will function without interruptions, delays, or errors. Third-party service availability (OpenAI, Firebase) may affect App functionality.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any errors or inaccuracies in AI-generated content
  • Any unauthorized access to or use of your data
  • Any interruption or cessation of the Service
  • Any conduct or content of third parties using the App
  • Legal issues arising from recording without proper consent

10.5 Maximum Liability

In no event shall our total liability to you for all claims exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Your failure to obtain proper recording consent
  • Any content you create, upload, or share through the App

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App or via email. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

14. Termination

14.1 By You

You may stop using the App at any time by uninstalling it from your device and canceling your subscription through your App Store or Google Play account.

14.2 By Us

We may terminate or suspend your access to the App immediately, without prior notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

14.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.
