Terms of Use

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Vishwesh Pratap Singh ("Developer", "we", "us", or "our") regarding your use of the German Citizenship Test mobile application ("App" or "Service").

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

German Citizenship Test is an educational mobile application designed to help users prepare for the official German citizenship test (Einbürgerungstest). The App provides:

• 460 official German citizenship test questions in 10 languages
• Practice tests and mock exams
• Study materials and lessons
• Progress tracking and analytics
• Achievement system and gamification features
• Bundesland-specific content for all 16 German federal states

Educational Purpose: The App is provided for educational and informational purposes only. It is a study aid and does not guarantee success in the actual German citizenship test.

3. User Eligibility

To use this App, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

4. Subscription Terms and In-App Purchases

4.1 Free and Premium Tiers

The App offers both free and premium subscription tiers:

Free Tier:

• Limited access to 50 questions
• Access to Chapter 1
• 1 mock test per day
• Basic analytics

Premium Tier (Subscription Required):

• Unlimited access to all 460 questions
• All 4 chapters unlocked
• All 16 Bundesland-specific content
• Unlimited daily mock tests
• Custom test builder
• Complete analytics dashboard
• Ad-free experience

4.2 Subscription Plans

Premium subscriptions are available as:

• Annual Subscription: Billed once per year
• Weekly Subscription: Billed weekly, with or without free trial

Subscription prices are displayed in the App and may vary by region. Prices are subject to change with notice.

4.3 Auto-Renewal

Important: All subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.

Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. The renewal cost will be the same as the original subscription price unless you are notified otherwise.

4.4 Free Trial

Some subscription plans may offer a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Free trials are available only once per user.

4.5 Managing Subscriptions

You can manage and cancel your subscriptions through your Apple ID account settings:

1. Open iOS Settings
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "German Citizenship Test"
5. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

4.6 Purchase Restoration

You can restore previous purchases by tapping "Restore Purchases" in the App. This requires an active internet connection and the same Apple ID used for the original purchase.

4.7 Refund Policy

All purchases are processed through the Apple App Store and are subject to Apple's refund policy. To request a refund, contact Apple Support directly or visit reportaproblem.apple.com.

We do not process refunds directly. Any questions about charges should be directed to Apple.

5. User Responsibilities and Acceptable Use

5.1 Permitted Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You may:

• Use the App for personal, non-commercial study purposes
• Access content you have properly licensed through purchase or subscription
• Provide feedback and suggestions for improvement

5.2 Prohibited Activities

You agree NOT to:

• Reproduce, duplicate, copy, sell, or exploit any portion of the App or its content without permission
• Modify, reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Use the App to distribute viruses, malware, or harmful code
• Attempt to gain unauthorized access to the App, accounts, or systems
• Use automated means (bots, scrapers) to access the App
• Share your premium subscription access with others
• Circumvent any access restrictions or security measures
• Misrepresent yourself or impersonate others
• Use the App in any way that violates applicable laws or regulations

Violation of these terms may result in immediate termination of your access to the App.

6. Intellectual Property Rights

6.1 Ownership

The App and all content, features, and functionality (including but not limited to information, software, text, graphics, logos, images, questions, lessons, and design) are owned by Vishwesh Pratap Singh or licensed from third parties and are protected by international copyright, trademark, patent, and other intellectual property laws.

6.2 License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device(s)
• Access and use the App for personal, non-commercial purposes

This license does not include the right to:

• Resell or make commercial use of the App or content
• Collect and use product listings or descriptions
• Make derivative works based on the App
• Download or copy content for the benefit of third parties

6.3 Trademarks

"German Citizenship Test" and associated logos are trademarks of Vishwesh Pratap Singh. You may not use these trademarks without prior written permission.

6.4 Official Test Content

The citizenship test questions are based on official materials from German government sources and are used for educational purposes. The app is not affiliated with or endorsed by the German government.

7. No Warranty and Disclaimer

7.1 Educational Tool Only

The App is an educational study aid and does NOT:

• Guarantee you will pass the German citizenship test
• Replace official study materials or courses
• Provide legal advice regarding citizenship eligibility
• Constitute official test preparation from German authorities

Your success depends on your own study efforts and understanding of the material.

7.2 Accuracy of Content

We strive to ensure the accuracy and currency of all content, but we do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App or servers are free from viruses or harmful components
• Results from using the App will be accurate or reliable

Changes to Test: The official German citizenship test may change. While we endeavor to keep content updated, we are not responsible for discrepancies between App content and the current official test.

7.3 Third-Party Services

The App integrates with third-party services (Apple App Store, Firebase, RevenueCat). We are not responsible for the availability, accuracy, or functionality of these services.

7.4 Device Compatibility

We do not guarantee the App will work on all devices or with all operating system versions. Device and OS compatibility requirements are listed in the App Store.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISHWESH PRATAP SINGH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the App
• Any unauthorized access to or use of your data
• Any interruption or cessation of the App
• Any bugs, viruses, or harmful code transmitted through the App
• Any errors or omissions in content
• Your failure to pass the German citizenship test

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED EUROS (€100), WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vishwesh Pratap Singh, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

10. Termination

10.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Canceling your subscription (if applicable)

10.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Technical or security reasons

10.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You must delete the App from all devices
• Paid subscriptions will not be refunded (except as required by law)
• All provisions of these Terms that should survive will remain in effect

11. Modifications to the App and Terms

11.1 App Updates

We reserve the right to:

• Modify, update, or discontinue any features of the App
• Change subscription pricing with advance notice
• Discontinue the App entirely with reasonable notice

11.2 Changes to Terms

We may update these Terms from time to time. When we make changes:

• The "Last Updated" date will be revised
• Significant changes will be communicated through the App
• Continued use after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using the App.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through:

1. Informal Resolution: Contact us at support@vishwenlabs.com to attempt resolution
2. Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable laws

12.3 Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any class or representative action.

12.4 European Users

If you are a consumer in the European Union, you have certain mandatory rights under EU law, and nothing in these Terms affects those rights.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

13.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms or your use of the App.

13.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14. Apple-Specific Terms

The following additional terms apply to your use of the App on Apple devices:

14.1 Acknowledgment

These Terms are between you and Vishwesh Pratap Singh only, not Apple Inc. Apple is not responsible for the App or its content.

14.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple App Store Terms of Service.

14.3 Maintenance and Support

Apple has no obligation to provide maintenance or support for the App. Contact us at support@vishwenlabs.com for support.

14.4 Warranty

Apple is not responsible for any warranty claims. Any claims, losses, liabilities, damages, costs, or expenses relating to failure of the App to conform to warranty may be directed to us.

14.5 Product Claims

Apple is not responsible for addressing any claims by you or third parties relating to the App or your possession/use of the App.

14.6 Intellectual Property

Apple is not responsible for any intellectual property infringement claims relating to the App.

14.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.

16. Acknowledgment

BY USING THE GERMAN CITIZENSHIP TEST APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
